Rules made pursuant to Section 4 of Regulation 15.1(1) The Library.
Identification
1. When borrowing library material in person, borrowers must produce their own valid borrower's card.
2. Off-campus borrowers must provide their student or library borrower number.
3. Proxy borrowers approved by the University Librarian must provide proof of identity.
4. The loss of a borrower's card must be reported to the Library immediately. The cardholder ay be responsible for any items borrowed up until the time the Library has received and acknowledged such a report.
Library Material5. Library material listed in the Library's catalogue is available for borrowing outside the Library with the following exceptions:
6. Some of these materials may in special circumstances be borrowed by arrangement with the University Librarian.
Loan Period
7. Students in under graduate courses may have on loan up to 20 items of library material at any one time. The loan period for these students is 14 days plus a mailing period for off-campus students, as determined by the University Librarian
8. Students undertaking studies at honours level and students enrolled in higher degrees by coursework may have on loan up to 30 items of library material at any one time. The loan period for these students is 14 days plus a mailing period for off-campus students, as determined by the University Librarian.
9. Staff, higher degrees research students and other approved borrowers may borrow up to 50 items of library material at any one time. The loan period for these borrowers is 28 days plus a mailing period for off-campus students, as determined by the University Librarian.
10. any student engaged in studies which require special borrowing privileges should submit reasons in writing to the University Librarian who shall consider such reasons on their merits.
11. Other persons may be authorised to borrow under Regulation 15.1(1) section2. The loan period for such persons is as approved by the University Librarian.
12. Additional items may not be borrowed if any loan is overdue.
13. The Library may recall any material lent for 14 or 28 days if it is required by the Library or requested by another library user, provided not less than seven days have elapsed since the material was borrowed. Items with existing hold(s) when borrowed will have an initial loan period of seven days only, and may not be renewed.
14. Certain types of material may be borrowed on extended loan by members of the academic staff or higher degrees by research students. Generally, the material eligible for such loans shall be laboratory manuals or highly specialised monographs required for extended use in connection with a research project, and not likely to be used within the Library. Such loans must be approved by the University Librarian and are subject to recall if required.
Renewals
15. A loan may be renewed provided that the material is not required by the Library or for another library user.
16. A renewed loan may be recalled at any time.
17. Students in undergraduate courses may have three renewal periods of 14 days each.
18. The following borrowers may have six renewal periods, equal in duration to the initial loan period:
19. Library material shall not be removed from the Library without the loan thereof having been first recorded in the manner prescribed by the University Librarian.
20. Library material on loan may not be transferred to another person. The person to whom the loan was made shall be solely responsible for the safekeeping and due return of the material borrowed.
21. Library material on open access shelves may be removed for use within the Library without reference to Library staff, but should not be replaced on the shelves by Library users. Materials should be left in the sorting areas or on the reading tables.
22. Library material not on open access may be obtained on application to the staff member on duty at the Loans Desk. Any such material must be returned to the Loans Desk after use.
23. Material issued for use within the Library must be returned to the place of issue by the end of the loan period.
24. Damage or defacement of library materials by marking, erasure or mutilation is strictly forbidden. Any loss, damage or defacement of library materials must be reported to Library staff.
25. Library users are permitted to use their own books and materials in the Library on condition that they present them for inspection at the exit control if so required by Library staff.
26. Library users must observe the special use restrictions which apply to material in the Special Collection
27. Copying within the Library shall be in accordance with the provisions of the Copyright Act 1968 (as amended).
28. Library users must refrain from any noisy or unseemly behaviour or other conduct likely to interfere with the comfort or convenience of other persons within the Library, or likely to damage or result in the unauthorised use of library material or other property of or in the care of the Library.
29. Eating, drinking and smoking are forbidden in any part of the Library
30. Conversation, including the use of mobile telephones, is not permitted in designated Silent Study Areas or in t book stacks adjacent to them. Quiet conversation is permitted elsewhere in the Library provided it does not interfere with other persons within the Library.
31. Library users may not alter the arrangement of Library furniture and fittings or misuse them in any way.
32. Litter is to be placed in the paper bins provided.
33. No broadsheets, handbills, newspapers or any materials other than official notices from the Library or other departments of the University with the authorisation of the University Librarian may be distributed within the Library.
34. Library users may not reserve study places. Any Library user absent for more than 15 minutes from the place that they have been using forfeits their right to that place. Their materials may be removed from the table and the place taken by another Library user.
35. Library users may not enter staff areas unless by invitation or when accompanied by a member of the Library staff.
36. All Library users are required to complete their loan transactions 15 minutes before closing time, begin leaving the Library five minutes before closing time, and to be out of the Library by closing time.
37. When a breach has occurred under any of the above sections the University Librarian may impose any one of the penalties set out in 46 below.
38. A borrower with overdue Library material will accumulate one penalty point per item for each day the Library is open for business after the due date.
39. If an item has been recalled for another Library user the rate is three penalty points per day, commencing five days after the recall notice has been despatched.
40. For items in the Reserve Collection the rate is five penalty points per hour overdue.
41. When a borrower accumulates 100 penalty points in a year they are blocked from any further borrowing until cleared by Library staff. A borrower who has accumulated 100 penalty points may be suspended from borrowing for four weeks. If a borrower is suspended their penalty points are reduced to 50 after the suspension.
42. Should the borrower accumulate 100 penalty points again within the year they will be blocked from any further borrowing for four weeks.
43. If a borrower is blocked from borrowing at any time they may continue to make use of the collections within the Library and borrow laptop computers or items from the Reserve Collection - but not for overnight loan.
44. Where material has been lost or returned damaged or not returned after a reasonable period, the University Librarian may require the borrower to pay the cost of repair or replacement of the material together with a service charge calculated to cover the administrative costs involved.
45. The University Librarian shall have the discretion to determine whether an average replacement cost of library material or the actual replacement cost in the case of an item which is very cheap or very expensive shall be charged. The average replacement cost is currently $110.
46. If a user of the Library has committed a breach of these Library Conditions of Loan and Use, the University Librarian may impose one or more of the following penalties:
47. If in the opinion of the University Librarian the alleged breach of the Conditions amounts to an offence under Regulation 4.1(1) Student Discipline, then the provisions set out in that regulation may be applied.
48. Equipment listed in the Library catalogue may only be borrowed in person by Deakin University staff and students.
49. Equipment listed in the Library catalogue is normally available for borrowing outside the Library, with the exception of laptop computers designated for in-Library study purposes.
50. Equipment that is available for loan outside the Library may be booked for a specific date, in the name of the person that shall be borrowing the equipment.
51. When borrowing equipment, staff and students must produce their own valid borrower's card and sign a loans agreement form. Loans agreement forms for students must also be authorised by the appropriate lecturer or tutor.
52. Equipment may only be borrowed and used for the educational purposes of the University.
53. The term of the loan shall be the period specified on the Library computer system record.
54. A limit on the number of items that may be borrowed will be set at the discretion of the University Librarian.
55. An extension may be granted on the original loan period, provided that the equipment is not required by the Library or for another authorised user.
56. The borrower shall not dispose of, part with possessions of or otherwise deal with the equipment , other than to deliver it to the University upon expiry of the loan.
57. At the end of the loan period, equipment issued for loan must be returned in good repair to the place of issue.
58. a borrower with overdue equipment loans will accumulate one penalty point per hour for each overdue item, and will be subject to the 100 penalty points conditions (see paragraph 41).
59. Where equipment has been lost, returned damaged or not returned after a reasonable period, the borrower will be required to pay to the University an amount estimated by the University to be the cost of repair or replacement of the equipment. The amount shall be a debt, fine or imposition die to the University.
60. Breach of any term of this agreement may result in withdrawal of library services or other sanctions pursuant to the legislation of the University.
