Content
This is the second of two units covering the general principles of Australian contract law. Contract Law and Policy A unit addresses the validity requirements for contracts and the scope of contracts validly formed. Part B, this unit, deals with what happens when contractual dealings go wrong. We start by looking at how an apparently valid contract can be set aside for various reasons such as misleading and deceptive conduct under Australian Consumer Law, and for mistake, duress, undue influence, unconscionability and illegality at common law and equity. We then look at how contracts come to an end: whether it is by performance, by agreement, by breach or frustration. The final part of the unit deals with remedies. This is where we cover what the innocent party can recover when the other side has not performed. These consist of common law remedy of damages and equitable remedies of specific performance and injunctions. Policy considerations underlying the topics are covered alongside doctrine. Much of the work is done through problem scenarios of the kind you will meet in legal practice.
